
New South Wales (NSW):
If a tenant falls more than 14 days behind on rent or utility charges, a non-payment termination notice can be issued by the landlord or property manager, requiring the tenant to vacate with at least 14 days’ notice.
However, tenants are not required to vacate if they:
- Pay the outstanding rent or charges in full, or
- Enter into and comply with a repayment plan agreed with the landlord
In most cases, if payment is made or an agreement is reached, the notice becomes void.
If the issue remains unresolved, the matter must go through the NSW Civil and Administrative Tribunal (NCAT), which can take 4 to 6 weeks to schedule a hearing. It’s a formal process that takes time, and tenants are not automatically removed after 14 days.
When it comes to early lease terminations, tenants are generally required to pay a break fee, calculated based on how far along they are in the lease term.

Victoria (VIC):
- Once rent is more than 14 days overdue, a Notice to Vacate can be issued, giving the tenant 14 days to leave the property.
- If a tenant breaks the lease early, they may need to cover the landlord’s reasonable costs, such as lost rent until a new tenant is secured, as well as re-letting and advertising expenses.

The first routine inspection can be carried out three months after the tenancy begins. After that, inspections may be conducted as often as every three months.
Victoria (VIC):
The initial inspection can take place three months into the tenancy. Following that, inspections are allowed once every six months, with a maximum of two inspections in any 12-month period.
Rent is collected from tenants on a regular basis and disbursed to landlords monthly by default, with funds transferred directly to the landlord’s nominated bank account.
For larger clients or by special arrangement, fortnightly disbursements can be accommodated if needed.
